Gladstone Regional Council victorious over change to approved land lease community

Queensland’s Planning and Environment Court has dismissed an appeal by Brades Property Agnes Water, upholding Gladstone Regional Council’s refusal of a proposal to swap an approved 360-lot manufactured housing estate (land lease community) for a 158-home conventional residential subdivision at Agnes Water.

In his decision, Judge William Everson found the alternate scheme failed on several fronts: “The proposed development is in serious conflict with a number of provisions of the planning scheme. A sufficient level of community and economic need for the proposed development has not been demonstrated. Further, the proposed development makes no attempt to address the significant biodiversity and ecological values of the site.”

The site already carried approval, granted on 7 May 2019, for a manufactured housing estate. Land immediately to the west is being developed for 201 manufactured homes, while adjoining land to the east has approval for a further 190 dwellings. The area to the northeast forms part of an adjoining residential housing estate.

Two land lease communities already operate in the town – Stockwell’s Solana Lifestyle Resorts Agnes Water and Riverbend Agnes Water – reflecting rising demand from retirees relocating to the region.
