Class actions against Victorian aged care providers Heritage Care and St Basil's Homes for the Aged on behalf of families of residents who died during the COVID-19 pandemic have appealed a ruling rejecting their bid for insurance and financial information to help with mediation.
The Carbone Lawyers-led class actions allege the two homes did not exercise reasonable care and skill caring for residents in 2020.
On 4 July, Registrar Andrew Baker rejected their bid for the information due to concerns about the nursing homes' financial positions.
The class actions are now appealing that decision, it has been reported in Lawyerly.
The Heritage Care and St Basil’s Homes for the Aged COVID-19 outbreaks in 2020 accounted for more than 50 deaths.
