NSW Land and Environment Court approves Adria Care’s retirement village plan for Wollongong’s Croatian community

After agreeing to reduce the number of units and the height of the development, a continuum of care project wrapping around the Croatian Catholic Church in the suburb of Figtree has finally been approved three years after it was first lodged.

Adria Care, which owns and operates Adria Village in Stirling, a suburb of Canberra, lodged a development application in 2022 for 22 independent living units and a 102-bed aged care home which was rejected by the Southern Regional Planning Panel in September 2023.

Adria Care appealed to the NSW Land and Environment Court and the court ordered the two parties to attend a conciliation conference, where changes to the original application were made.

"The amended development application was filed on April 17, 2025, and has reduced height,  floor space ratio and unit numbers from what was originally proposed, and it includes a culvert for managing the overland flow during storm events, as well as a landscape design for the open space areas," Commissioner Joanne Grey's ruling stated.

Wollongong City Council had expressed concerns about the height of the structure which, at 14.6 metres, was higher than the 12.8-metre maximum allowed. 

Commissioner Grey accepted the developer's lodged request to overlook the non-compliance and formally approved the development, while also ruling Adria Care pay the Council's costs.
