Sydney property developer takes Merimbula senior housing plan to NSW Land and Environment Court

A $40 million plan for Merimbula Lifestyle Village, on the NSW Far South Coast, will be decided by the courts after the DA was deemed a refusal.

Sydney property developer Justice Fox wants to put almost 90 units across two buildings, one four storeys high and the other five storeys on Lakewood Drive.

A community meeting to discuss the proposal attracted more than 100 nearby residents, who objected to the proposal on grounds including traffic, light and noise pollution, and potential impact on the local environment.

The approval of the DA is currently with the Southern Regional Planning Panel but because a determination hasn’t been made within 45 days, Bega Valley Shire mayor Russell Fitzpatrick said the developer can appeal it at the Land and Environment Court.

A second exhibition period is open until 15 June for community comments and the Mayor urged anyone wishing to make submissions to get them to Council and promised that all submissions would get forwarded to the SRPP and the Land and Environment Court.
