East Coast land lease developer faces legal action over retirement unit redevelopment

As we reported here, Allswell Communities had already been forced to change its redevelopment plans at its Coastal Palms Holiday Park in Shoalhaven Heads on the NSW South Coast.

Now 31 casual occupants at its Tomaga River Holiday Park in Tomakin are considering legal action after being ordered to vacate their sites by 31 August.

Under NSW law, holiday park owners only have to give 90 days’ notice to long-term casual occupants to leave.

Allswell plans to rezone around 90 casual occupancy sites at the park as it increases the number of permanent residential sites from 17 to 89.

They are offering the occupants a $5,000 payment provided they have paid their site fees and cleared their sites, but the residents say it won’t cover their relocation costs.

But Allswell maintains it has always acted within the law and the NSW Holiday Park Act states any dwelling has to be “kept in a condition allowing it to be moved”.

They have seven land lease communities in QLD, NSW and VIC, five co-located with holiday parks.
